Terms of service

These terms govern your use of Tenwise, the self-management software operated at tenwise.com.au by Foreshore Studio Pty Ltd (“Tenwise”, “we”, “our”). By creating an account or submitting an application through a Tenwise listing, you agree to them.
Who can use Tenwise
You can create a landlord account if you are at least 18, are the owner (or an authorised representative of the owner) of an Australian residential rental property, and intend to manage that property yourself. You can submit applications, RSVPs and enquiries as a prospective tenant from age 16, in line with state tenancy legislation.
What Tenwise provides
Tenwise is software. We are not a real-estate agent, a licensed property manager, or your legal adviser. We provide:
- Tools to list, screen, sign, and collect rent on a property you own
- State-specific lease templates and notices that we keep up to date
- A simple way to set up and track rent, which your tenant pays you directly by bank transfer
- Plumbing to state rental-bond authorities so bond is lodged with them, not us
- Electronic signing of the agreement through Annature, an Australian e-signature provider — valid under the Electronic Transactions Act, with a signing audit trail
- In-app help from an AI assistant that is upfront that it’s an assistant and hands off to a person when you need one
We do not act on your behalf as your agent. We do not hold your money. We do not hold your bond.
Your responsibilities as a landlord
- You are the principal in every tenancy you create through Tenwise. The lease is between you and your tenant.
- If your property is co-owned, you must enter the other owner’s details accurately and have their authority to act. Both owners are named on the agreement and sign it.
- You provide an address for service of notices, which appears on the tenancy agreement so notices can be validly served.
- You are responsible for complying with the residential tenancy legislation of your state, including notice periods, bond lodgement timeframes, repairs, and condition reports.
- You are responsible for the accuracy of the listings, ad copy, and notices you publish via Tenwise — including any AI-drafted ad descriptions, which you must review before publishing.
- You may not discriminate against applicants on protected grounds (race, sex, gender identity, sexual orientation, disability, age, religion, family/marital status) under the relevant Commonwealth and state anti-discrimination laws.
- You will not charge applicants for screening (a separate requirement in NSW under section 30A of the Residential Tenancies Act 2010 (NSW), and increasingly in other states).
Your responsibilities as a tenant or applicant
- The information you provide in an application must be true and complete to the best of your knowledge.
- Consent to background and tenancy-database checks is your explicit decision. You can withdraw an application at any time before the lease is signed.
- You are responsible for the obligations under any lease you sign through Tenwise — rent, condition of the property, notice on termination — in line with your state’s tenancy law.
Pricing and billing
- Tenwise is priced per property, billed via Stripe: $19 per month for your first property and $9 per month for each additional property (or $189 and $89 per year respectively). Pricing scales linearly with the number of properties on your account, with no cap.
- There is no setup fee, no letting fee, no lease-renewal fee, no fee per inspection, and no percentage of your rent.
- Introductory offers.Monthly plans start with a free first month — billing begins in month two, and you can cancel any time before then. Annual plans come with a 30-day money-back guarantee: tell us within 30 days of the annual charge for a full refund.
- You can cancel at any time from Settings. Apart from the 30-day money-back guarantee and the pro-rata refund under the Transparent Pricing Policy below, annual plans aren’t pro-rated on routine cancellation, but you keep access until the end of the billing period.
- Tenwise pays for tenancy-database screening (such as TICA). Neither the landlord nor the applicant is charged for it.
- Transparent Pricing Policy.We won’t increase the price of your subscription during your first 12 months. After that, if we change the price that applies to your account, we will give you at least 60 days’ written notice before the change takes effect. You can cancel before the new price applies and receive a pro-rata refund of any prepaid time. This policy applies to standard accounts.
- Founding Members. If you joined as a Founding Member (the first 200 landlords, paying a single one-off $199), your price is locked for the lifetime of your account and will never increase. The Founding Member rate is tied to your account and is not transferable.
Money handling
Rent is paid by direct bank transfer between your tenant and you — Tenwise never holds, processes, or has access to your money. Bond is lodged with your state’s rental-bond authority under the statutory timeframes, not with us.
Data ownership and export
You own the personal data and tenancy records you create on Tenwise. You can export your data as CSV (enquiries, applications, rent ledger) or PDF (signed leases, bond receipts) at any time. We will not hold your data hostage if you decide to leave.
What we won’t do
- We won’t give you legal advice. Use a lawyer for legal questions. Our state-templated forms are written to match the law as we understand it, but they don’t replace independent legal advice.
- Both you and your tenant are entitled to obtain your own independent legal advice before signing any document, and we recommend it for anything you’re unsure about. As the landlord, you remain responsible for complying with the residential tenancy laws that apply to your property.
- We won’t represent you in a dispute with a tenant or at a state tenancy tribunal. We’ll provide the records you need to represent yourself.
- We won’t share your data with anyone outside the parties listed in our Privacy policy.
Suspension and termination
We may suspend or close an account if it is used to break the law, breach these terms, or to harm Tenwise or another user. You can close your account at any time from Settings— data retention after closure is governed by the Privacy policy.
Liability
To the extent permitted by the Australian Consumer Law, Tenwise is provided “as is”. We don’t warrant that the service will be uninterrupted or error-free. Our total liability under or in connection with these terms is capped at the fees you have paid us in the twelve months preceding the claim. Nothing in these terms excludes or limits any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Governing law
These terms are governed by the laws of New South Wales, Australia. The Australian courts have non-exclusive jurisdiction.
Changes
We’ll email you before any material change to these terms takes effect. If you don’t accept the change, you can close your account and export your data.
